COMPETITION REGULATIONS: Brussels Airport Festival Competition

ARTICLE 1: The organiser

This competition without purchase obligation is organised by Brussels Airport Company (BAC) plc, registered at ‘Diamant’ Building A, Reyerslaan 80, 1030 Schaerbeek, Belgium, henceforth "Brussels Airport". Participation in the competition implies unconditional acceptance of the provisions of these regulations and any decision Brussels Airport is required to take in the context of this competition.

ARTICLE 2: Who can enter?

2.1 Entry in the competition is open to everyone over the age of 18 residing in Belgium, the Netherlands or France. As the competition is entered online, no communication costs are charged. Participation is completely free.

2.2 Those excluded from entry in the competition include: employees of Brussels Airport (as well as their immediate relatives), Brussels Airport partners, their advertising agencies and any other persons who have contributed to the creation of the present competition.

Anyone entrant who wins a prize who does not comply fully with the present competition regulations automatically forfeits their right to any and all prizes without right to compensation or counter-claim.

ARTICLE 3: Duration

The competition runs from 04/07/2017 until 11.55 pm on 31/08/2017 (the closing date of the competition). This period may be extended, interrupted or terminated by Brussels Airport at any time and without notice.

ARTICLE 4: Content and conduct of the competition

The competition can only be entered by visiting the website www.festivalatbru.be. Entrants are required to identify well-known Belgian musicians displayed on screen within the displayed time limit and then fill in their personal details. Entrants are also required to answer a tiebreaker question and choose whether or not they wish to be informed of future offers from Brussels Airport.

The 5 entrants who guess all 4 artists correctly and whose answers to the tiebreaker question come closest to the correct answer will win 1 of the 10 available prizes. Any incomplete entry will be deemed invalid. Each individual entrant may enter only once.

ARTICLE 5: The prizes

5.1 Each of the 5 main prizes is identical and consists of the following:

There will be 5 winners determined from: 4/7/2017 until 31/7/2017.
There will be 5 winners determined from: 1/8/2017 until 31/8/2017.

5.2 The first 5 winners will be informed by email on 1 August. They have to submit the necessary data before 4 August, so the prize can be delivered. The other five winners will be informed by email on 1 September. Their deadline to submit the necessary information is 6 September, after which the prize can be delivered. The prizes won will be sent within 5 days following the provision of addresses.

Should the information not be submitted on time, a different winner will be selected.

5.3 Prizes are strictly personally and cannot be transferred or redeemed for cash. Prizes may also not be given to 3rd parties for free or offered for sale or auction. In the event the winner attempts to sell the prize (e.g. by offering it for sale or auction via a newspaper, website or any other medium), Brussels Airport reserves the right to withdraw the prize without right of compensation or counter-claim. The prize will then be awarded to the next eligible entrant.

ARTICLE 6: Announcement of the winner

The winner will be notified by e-mail by Brussels Airport on 01/08/2017 or 01/09/2017.

ARTICLE 7

7.1 Contact information provided by entrants to Brussels Airport will be used solely for the purposes of contacting them in the event they win a prize and will not be kept longer than necessary. IP address may also be recorded and analysed, in the event of a dispute or suspicion of match fixing and to check whether the entrant is from one of the eligible countries.

Entrants may view and/or correct this information free of charge by sending a letter to Brussels Airport at the above address including a copy of their identity card. Entrants may also choose to be informed of Brussels Airport’s activities by e-mail via an "opt-in" option when entering.

7.2 The stipulations of article 6 notwithstanding, details of the competition will not be communicated either digitally or over the phone. No correspondence will be entered into either during or following the competition.

ARTICLE 8: General provisions

8.1 Brussels Airport reserves the right to replace the content of any prizes either completely or partly with an equivalent prize, in the event the previously communicated prize is unavailable, without any right to compensation or counter-claim in respect of the winner. Brussels Airport also reserves the right to change, delay, shorten or cancel the competition or part of the competition, in the event such action is required due to programmatic, technical or organisational circumstances. In the event any individual provisions of these competition regulations should be deemed invalid and/or unenforceable, all other provisions as outlined in the present regulations remain valid. Brussels Airport will replace any such provision with a valid provision which corresponds, as far as legally possible, to the intention and content of the original provision.

8.2 In the event the conduct of this competition is interrupted by a technical incident, e.g. if the website goes offline, Brussels Airport will do everything in its power to minimise the impact. However, Brussels Airport cannot be held liable for any disadvantage arising from such technical incidents. In the event of abuse, deception or fraud, Brussels Airport explicitly reserves the right to exclude any involved entrant(s) from participating in the present and/or future competitions.

These regulations are published on the Brussels Airport websites listed in Art. 4 of these Regulations and may be printed there if desired. All additional publications related to the competition are subject to the regulations unless otherwise clearly stated. All decisions taken by Brussels Airport in connection with this competition are final and irrevocable. An overview of the paid prizes can be obtained by letter by writing to Brussels Airport at the above address, including a stamped, self-address envelope. Any complaints concerning the conduct of the competition may also be sent to the above address, after which Brussels Airport will contact you. This notwithstanding, no correspondence regarding other aspects of the competition will be entered into by Brussels Airport.

8.3 Only one prize per address, per family, per IP address will be awarded. Any attempted fraud will result in immediate exclusion of the entrant from the competition. Any attempt to enter the competition in an organised fashion, whether it be in the framework of a legal or factual association or by working in one way or another to increase the chances of winning, will also result in exclusion from the competition. The same measures will be taken with regards to anyone who takes action via the use of e.g. a list or computer program, or any other illegal or deceptive practice designed to increase their chances of winning.

ARTICLE 9: Applicable law and competent courts

These regulations are drafted subject to Belgian law. Any dispute concerning the competition and/or these regulations must first be submitted to Brussels Airport. If mutual consultation does not provide a suitable outcome, the dispute will be heard exclusively by the competent court in the district of Antwerp.

ARTICLE 10: Right of exclusion

Brussels Airport reserves the right to exclude any person from entering any of its competitions at any time and for a specified period, in the event any of the present regulations are contravened as a result of abuse, deception or any other conduct in bad faith with regards to a competition organised by Brussels Airport.

ARTICLE 11: Force majeure

Brussels Airport reserves the right to make changes to the competition or its organisation in the event of unforeseen circumstances and/or circumstances beyond its control. In such cases, Brussels Airport shall not be held liable in the even the competition is interrupted, postponed or canceled as a result of force majeure.

ARTICLE 12: Communication of winners

Brussels Airport reserves the right to communicate about the winners for promotional purposes.

ARTICLE 13: Acceptance of the present regulations

Entry in this competition implies acceptance of the present regulations without restriction. No dispute will be accepted regarding the wording of the questions or answers to the questions.

ARTICLE 14: Designated court bailiffs

The present competition is conducted under the auspices of Messrs. Ronnie De Ceuster and Lucas Engels, registered court bailiffs in the district of Antwerp, Belgium.

In the event of unavoidable casualty, force majeure or dispute, Brussels Airport shall, in consultation with the designated court bailiffs, take every necessary decision to ensure the proper conduct of this competition. Their decision is final and not correspondence regarding such decisions will be entered into.

ARTICLE 15: Privacy and the processing of personal information

The entrant grants explicit permission for the automated processing of their personal data by Brussels Airport in order to ensure the smooth conduct of the competition and to inform the entrant about current and future offers from Brussels Airport.

In accordance with the laws of 8 December 1992 and 11 December 1998 on the protection of privacy, entrants may consult this personal data or request corrections or modifications by simple written request to the above address. This also applies in the event entrants no longer wish for their person details to be used for direct marking purposes.

Participation in this offer implies unconditional acceptance of the present terms and conditions and any decision Brussels Airport is required to take in relation to this offer.

ARTICLE 2: Duration

The offer, comprising the possibility of playing the relevant playlists, runs from 22/05/2017 to 11.55pm on 31/08/2017. This period may however be extended, interrupted or terminated by Brussels Airport at any time and without notice.

ARTICLE 3: Content of the offer

In order to take advantage of this offer, participants must visit the website www.brusselsairport.be/festival. This page contains links to the Brussels Airport holiday playlists which can be listened to via Spotify. Visitors to the page can choose between playlists with a holiday destination theme or a specially compiled playlist by Lost Frequencies. Visitors can also choose whether they wish to be kept informed of future offers from Brussels Airport.

ARTICLE 4: Personal details

Via a so-called “opt-in” checkbox, participants can choose to receive promotional e-mails from Brussels Airport with details of upcoming offers and activities at the airport. Participants may view and/or correct information stored for these purposes free of charge by sending a letter to Brussels Airport at the above address including a copy of their identity card.
